Terms of Use

These terms govern your use of mercureindustries.com and your inquiries with Mercure Industries. By using the site or submitting information, you agree to them. A signed listing or purchase agreement for a specific deal controls over these terms where they differ.

Our role

Mercure Industries is a broker. We list equipment on consignment and introduce buyers and sellers. We do not take ownership of the equipment, and we are not the manufacturer, dealer or warrantor of any machine.

Valuations and listings

Valuations are estimates based on market information and the details you provide. They are not appraisals for lending, tax or insurance purposes and are not a guarantee of sale or price. Equipment Wanted requests reflect buyer interest and are not binding offers.

Seller responsibilities

• Provide accurate descriptions, including hours, condition and known defects.
• Have the right to sell the equipment and disclose any liens, loans or leases.
• Make the equipment available for buyer inspection as agreed.

Buyer responsibilities

• Sales are FOB origin: the buyer arranges and pays for de-installation, rigging, loading, freight and insurance in transit.
• The buyer is responsible for inspecting the equipment and confirming it suits their needs before funds are released.
• Funds are paid through third-party escrow, which releases payment according to the agreed terms.

Used equipment, as-is

Unless a written agreement says otherwise, equipment is sold as-is, where-is, without warranty of any kind, including merchantability or fitness for a particular purpose.

Fees

Our fees are set out in the listing agreement for each deal, either as a commission or as a net-to-seller arrangement. There is no charge to request a valuation.

Acceptable use

Do not submit false information, attempt to bypass us to contact a counterparty we introduced, or interfere with the site's operation.

Limitation of liability

To the extent permitted by law, Mercure Industries is not liable for indirect, incidental or consequential damages, or for the condition, performance or transport of equipment. Our total liability for any claim is limited to the fees we received for the transaction involved.
